1. Who we are
Daring Tales is run by a sole trader (micro-entrepreneur) registered in France.
- Contact: our Contact page
In these terms, “we” and “us” mean Daring Tales. “You” means the person who places the order. Please read these terms before you order. By placing an order, you accept them.
2. What we make
We make personalized animated movies, about 5 minutes long, starring your child. We create each movie from one photo of your child and the first name you give us, using AI image and video tools under our creative direction.
When you order, you can choose:
- 1 movie.
- 3 movies: the movie you previewed and 2 more worlds, with a free movie poster.
- Full season: 6 episodes, with a free movie poster and 5 coloring pages. Episode 1 comes first, the next five as they’re released.
- Express delivery, as an add-on.
Discount codes, such as SECONDMOVIE for a second movie, work only under the conditions shown with the offer. They have no cash value.
3. Who can order
You must be at least 18. You must be a parent or legal guardian of the child, or have their permission to order a movie of the child (for example, if you are a grandparent).
4. The photo you send
When you upload a photo, you confirm that you are a parent or legal guardian of the child, or that you have their permission, and that you have the right to use the photo. Please send only a photo of the child the movie is for.
We may refuse a photo or an order that breaks the law, could harm someone, or uses a child’s image without permission. If you have already paid, we refund you in full.
We use the photo only to make your preview and your movie. Our Privacy Policy explains how we store it and when we delete it.
5. Free preview and ordering
You upload a photo and we make a free preview that shows your child in the story, before you pay. The preview costs nothing and you don’t have to buy anything.
If you like it, you choose your options and pay at checkout. Your order is confirmed when your payment goes through, and we send you a confirmation email.
6. Prices and payment
The price shown at checkout, including any tax we must collect, is the price you pay.
Card payments are handled by Stripe. We never see or store your full card number.
7. Delivery
Your movie is digital. Nothing is shipped. We send it by email with a private link:
- Delivery: by email within 24 hours after payment.
- Express delivery, if you add it: by email within 30 minutes after payment.
- Full season: Episode 1 within these times, the next five as they’re released.
Our Delivery Policy has the details.
8. Your right to cancel
Your movie is personalized digital content, made just for you. Right next to the button that takes you to checkout, we tell you that by continuing you:
- ask us to start making and supplying your movie right away; and
- confirm that you understand you lose your right to cancel once your movie is made available to you, meaning once you can stream or download it.
We repeat this in your order confirmation email.
Until your movie is made available, you can still cancel. Message us and we refund you in full. After that, you can no longer cancel, but our redo-or-refund promise below still applies, along with your legal rights.
This follows the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (regulation 37) and, for customers in France and the rest of the European Union, article L221-28 (3° and 13°) of the French Consumer Code, which applies EU Directive 2011/83/EU.
9. Our redo-or-refund promise
If something is wrong with your movie, for example your child’s face doesn’t look right or their name is wrong, message us. We remake the movie for free.
If we can’t fix it, or if your movie is not delivered on time, we refund your order. Please ask within 30 days of the promised delivery time. Our Refund Policy explains how it works.
This promise comes on top of your legal rights, which we cannot exclude:
- in the UK, the Consumer Rights Act 2015 covers digital content;
- in France and the EU, the legal guarantee of conformity for digital content applies (articles L224-25-12 and following of the French Consumer Code);
- in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these terms limits those rights, or any other consumer rights your local law gives you.
10. How the movie is made
We make the movie with AI image and video tools. The result is an animated version of your child, not a photo, so it can differ a little from the picture you sent. That’s why you see a free preview first, and why we remake the movie if the face doesn’t look right.
11. Using your movie
Your movie is for personal, non-commercial use, with no time limit. You may watch it as often as you like, share it with family and friends, show it at a private event and post it on your personal social media accounts.
You may not sell it, put it on streaming platforms or use it in advertising without our written permission. The story, the settings, the other characters and the music belong to us or to the people who license them to us.
We never use your child’s photo, preview or movie on our website, on social media or in ads without your written permission.
12. Our responsibility
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for losses that were not foreseeable, or for business losses, since our movies are for personal use. Where the law allows, our total responsibility for an order is limited to the price you paid for it.
Nothing in these terms limits our responsibility where the law does not allow it, for example for fraud, or for death or personal injury caused by our negligence.
13. Complaints
If you have a problem, please write to us first through our Contact page. We will do our best to solve it quickly.
14. Governing law
These terms are governed by French law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring a claim in the courts there if your local law allows it.
15. Changes to these terms
We may update these terms. The version in force on the day you order applies to your order.
